TERMS AND CONDITIONS

I. GENERAL PROVISIONS

1. The administrator of the Website and the Service Provider is Flexhouse sp. z o.o., with its registered office in Warsaw at ul. Ostródzka 245b/7b, 03-289 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0000430927, Tax Identification Number (NIP) 5242752901, National Official Business Register Number (REGON) 146254492, share capital: PLN 5,000.00, hereinafter the “Service Provider”.

2. These Terms and Conditions set out the rules for using the website available at www.flexhouse.pl (hereinafter the “Website”) by Clients who are Entrepreneurs, as well as the rules for entering into and performing agreements within the scope of the Service Provider's business activity.

3. The Terms and Conditions are made available on the Website free of charge in a manner that enables them to be accessed, reproduced and stored.

II. DEFINITIONS

1. Website – the website available at www.flexhouse.pl.

2. Service Provider – Flexhouse sp. z o.o., with its registered office in Warsaw at ul. Ostródzka 245b/7b, 03-289 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number 0000430927, Tax Identification Number (NIP) 5242752901, National Official Business Register Number (REGON) 146254492, share capital: PLN 5,000.00.

3. Goods – the goods offered by the Service Provider.

4. User – an entity using the Website.

5. Client – an Entrepreneur within the meaning of item 6 below who enters into or intends to enter into an Agreement with the Service Provider.

6. Entrepreneur – a natural person, legal person or organisational unit without legal personality to which the law grants legal capacity, conducting business or professional activity in its own name and performing a legal act directly related to its business or professional activity.

7. Terms and Conditions – these terms and conditions of the Website.

8. Agreement – an agreement within the scope of the Service Provider's business activity, entered into between the Service Provider and the Client, the terms of which are agreed individually with the Client in each case after the Client contacts the Service Provider, and which is entered into only after the Client expressly confirms the content of the offer prepared for the Client.

9. Electronic Services – services provided by the Service Provider to Clients through the Website by electronic means within the meaning of the Polish Act of 18 July 2002 on Providing Services by Electronic Means.

10. Business Days – Monday to Friday, excluding public holidays.

III. CONTACT WITH THE SERVICE PROVIDER

1. The Service Provider may be contacted:

  • a) electronically at the following e-mail address: flexhouse@flexhouse.pl,
  • b) in writing at the registered office address indicated above.

2. Client enquiries are handled on Business Days (Monday to Friday) between 9:00 a.m. and 5:00 p.m.

3. Client enquiries sent by e-mail or through the contact form available on the Website may be submitted 24 hours a day, 7 days a week; however, they will be reviewed on Business Days.

IV. NATURE OF THE WEBSITE AND THE GOODS PRESENTED

1. The Website is informational and presentational in nature and is intended in particular to showcase completed projects, sample solutions, materials and the Service Provider's general offering in the field of furniture manufacturing.

2. The information, photographs and descriptions provided on the Website do not constitute an offer within the meaning of Article 66 § 1 and Article 543 of the Polish Civil Code, but constitute an invitation to enter into an agreement.

3. An Agreement is entered into only after the Service Provider and the Client have individually agreed all material elements of the service and the Client has expressly confirmed acceptance of the offer in the agreed form.

4. The Client may contact the Service Provider to obtain information about its offering and to have an individual proposed agreement prepared, in particular:

  • a) through the contact form available on the Website,
  • b) by e-mail,
  • c) in writing.

5. Merely submitting an enquiry through the contact form available on the Website, by e-mail or by telephone does not result in an Agreement being entered into or create any payment obligation on the part of the Client.

6. After receiving an enquiry, the Service Provider contacts the Client to clarify the Client's requirements, in particular regarding the type of service, materials, dimensions and other material elements of the service.

V. TYPE AND SCOPE OF SERVICES PROVIDED BY ELECTRONIC MEANS

1. In connection with the operation of the Website, the Service Provider provides Users with free Electronic Services (hereinafter the “Service Agreement”).

2. Use of the Website is voluntary.

3. The following types of Electronic Services are provided:

  • a) making the contact form available.

4. The agreement for the provision of the Electronic Service consisting in making the contact form available is entered into when the User begins using that service, i.e. when the User accesses the page containing the contact form and uses it to send a message to the Service Provider. This agreement is a one-off agreement and terminates when the message is sent or the User ceases to use the form.

5. To use the Electronic Services, the User must meet the following minimum technical requirements:

  • a) access to the Internet,
  • b) an active electronic mail account (e-mail address),
  • c) a terminal device with an up-to-date web browser installed that enables websites to be displayed correctly.

6. The User is required to comply with these Terms and Conditions.

7. To ensure proper performance of the Service Agreement, the User is required in particular to:

  • a) refrain from supplying unlawful content, including content that infringes third-party rights or accepted standards of conduct, or that may constitute a prohibited act, including infringement of the economic copyrights, industrial property rights or personal rights of the Service Provider, third parties or other Clients of the Website,
  • b) use the electronic services provided by the Service Provider in accordance with applicable law, these Terms and Conditions and the principles of social coexistence,
  • c) refrain from taking actions in the field of information technology aimed at obtaining information not intended for the User.

8. The User declares that the User is aware of the risks associated with the Internet, in particular the possibility of unauthorised access to the User's ICT network, passwords being obtained by unauthorised persons, and the operating system and computer hard drives being infected with viruses, as well as the resulting consequences.

9. The Service Provider will exercise all due care to enable the Electronic Services to be used in accordance with these Terms and Conditions. However, the Service Provider reserves that periodic difficulties in accessing the Electronic Services may occur due to the characteristics of the Internet or insufficient parameters of the User's hardware or software.

10. By using the Electronic Services, the User declares that the User has read and accepts the Privacy Policy. The Privacy Policy contains the information required by personal data protection laws, in particular Regulation (EU) 2016/679 (GDPR), concerning the rules for processing personal data and the User's rights.

VI. COMPLAINTS REGARDING THE PROVISION OF ELECTRONIC SERVICES

1. The User may submit complaints regarding the provision of Electronic Services:

  • a) electronically to the following e-mail address: flexhouse@flexhouse.pl,
  • b) in writing to the Service Provider's registered office address.

2. A complaint regarding Electronic Services should include a description of the nature and date of the irregularity and the information necessary to identify the User.

3. The Service Provider will review a complaint regarding Electronic Services within 14 calendar days of receipt and will inform the User of the outcome and any remedial measures.

4. To the extent not governed by the preceding paragraphs, complaints regarding Electronic Services are subject, as appropriate, to the provisions of the Polish Act on Providing Services by Electronic Means.

VII. PERSONAL DATA

1. The rules for processing the personal data of Users and Clients are set out in the Privacy Policy available on the Website.

2. The Privacy Policy fulfils the information obligations arising from Regulation (EU) 2016/679 (GDPR).

VIII. FINAL PROVISIONS

1. These Terms and Conditions are governed by Polish law and the applicable provisions of European Union law.

2. Any disputes between the Service Provider and an Entrepreneur will be resolved by the Polish courts of general jurisdiction having territorial jurisdiction over the Service Provider's registered office.

3. Matters not governed by these Terms and Conditions are subject in particular to the provisions of the Polish Civil Code and the Polish Act on Providing Services by Electronic Means.

4. The Service Provider reserves the right to amend these Terms and Conditions for valid reasons, in particular due to changes in law, changes to the functionality of the Website, or organisational or technical changes.

5. Users will be informed of amendments to the Terms and Conditions by means of a notice on the Website. Amendments will take effect on the date indicated in the notice, which may not be earlier than 14 days after publication.

6. These Terms and Conditions enter into force on 13.09.2026.
